Work Accident Claims - Learning How to Say Sorry

May 31st, 2009

If you expect an apology from your bosses following a serious injury at work that is not your fault to begin with, then you are in for a big surprise — that isn’t very likely to happen. Actually, asking for an apology from your big bosses is like reaching for the moon and the stars, and this, in fact, is supported by studies and surveys.

Indeed, one research revealed that a vast majority of UK employers do not apologize in the event that their employees suffer from work-related accidents. 97% of employees who participated in a survey claimed that they didn’t get an apology from their bosses at all, clearly indicating that employers do not feel that they have a responsibility to their workers at all.

Perhaps the recession has something to do with the employers’ lack of concern for the general welfare of their employees. Making the recession an excuse can actually be detrimental to the employer himself. Employers fail to understand that by not taking the necessary steps to tackle the health and safety issues of their employees, they are putting themselves in a more disadvantaged situation.

Consider this, an employee who gets hurt will not be able to work, which means that the company or the employer will be losing lots of man hours. Moreover, an injured employee may file for a compensation claim against his employer, and this can cost him a lot of money in the process.

It is very important for any employer to ensure a safe and healthy environment for its workers. Employers need to be aware that even saying sorry may not stop an employee from filing for compensation claims. After all, mere lip service alone can not compensate for the lost income and lost opportunities, and of course the medical expenses. When an employee is injured, it is only natural for him to submit himself to medical treatment. Depending on the injury, it can take days, weeks, or even months to heal, and you must know how expensive the medicines are these days.

A compensation claim, is indeed, an employee’s best friend in times like this. It can certainly help him deal with all the medical expenses, and help him move on. In the same way, knowing that employees can file for a compensation claim should be a motivating factor for employers to take the necessary measures in ensuring the health and safety of their workers.

When you think about it, getting yourself injured at work is no joke. It is in fact a very big deal, especially if the injury is serious in nature that it will take a lot of time to recover physically and emotionally. Thus employers really should be responsible and caring enough to make their employees feel comfortable and well attended to in the midst of their injury. Even though apologizing is usually not enough, employers must learn how to say sorry, nonetheless. Who knows, these simple words may just lessen the impact of the injury.

May 29th, 2009

If you live in the city of Los Angeles or one of the surrounding areas and your child has suffered serious injury due to a swimming pool accident, contact the areas most knowledgeable and professional swimming pool accident attorneys.

It is summer time once again, which is the time of year that is otherwise known as ‘accident season’ that brings with it a slew of serious and fatal injuries. For most people, this is usually a time of the year that is full of lots of excitement and fun. However, you can generally expect that an endless amount of both Jacuzzi and swimming pool accidents will occur in many areas all around the world, and there are numerous conditions that can cause injuries sustained in swimming pool accidents.

One of the most common reasons that many of these accidents happen is simply because there are many homeowners that simply do not take the necessary time to devote the effort that is needed to properly clean and maintain a swimming pool. The area of concrete that you will generally find constructed around most all pools is an area that needs to be thoroughly cleaned on a regular basis

It is unfortunate and very irresponsible, but believe it or not there are a majority of homeowners that do not perform this important task, and when they do, it is certainly not done on any type of routine. Aside from the cleaning, there are also other maintenance tasks that should be checked regularly as well. When a diving board is attached to a pool it is important to check all of the parts it is constructed with to make sure that everything is as tight as it is meant to be.

A ladder is another object that many swimming pools have, and the parts on these ladders can often become loose and will need to be tightened. At times the concrete that has been poured around the pool will eventually become chipped and cracked over time, and then it will need to be repaired. Each of these may seem like minor issues, but they have been known to cause an endless amount of serious injuries that includes accidental death.

If your child has been swimming at another person’s home, and the neglected conditions have caused injuries sustained in a swimming pool accident, make sure that you contact swimming pool accident attorneys that will go to bat for you and make sure you receive the compensation that you are entitled to.

As many San Juan Capistrano car accident attorneys acknowledge, car collisions are not uncommon in this ocean-close community. With a population of nearly 37,000, San Juan Capistrano in Southern Orange County, California is taking steps to reduce its car collision rate.

Statistics compiled by the National Highway Traffic Safety Administration revealed that eight fatal car accidents took place from 2001 to 2003 in the city. This worked out to approximately 2.4 fatal car crashes per 10,000 population, which was below average for the country.

Looking at 2006 accident numbers listed by the California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS), we see that two people lost their lives and 125 sustained personal injuries in San Juan Capistrano car collisions. Bicycle vs. car accidents injured five and motorcycle collisions caused six injuries. Pedestrian vs. car crashes took two lives and injured four. Impaired drivers were responsible for one death and 21 injuries. Most knowledgeable car crash attorneys will say that car collisions happen frequently in cities this size.

Determined to reduce the number of car collisions in San Juan Capistrano, the city noted a number of issues. Traffic backing up at the Camino Capistrano exit of the southbound I-5 freeway created a dangerous road condition. The City also considered adding an extension of San Juan Creek Road to La Pata to decrease traffic on Ortega Highway. However, city commissioners expressed concern that the extension would add too much traffic to the existing quiet street and endanger Ambuehl Elementary School children. Finally, an extension of Las Ramblas to La Pata was also suggested to help reduce traffic on Ortega Highway.

To further reduce car crashes in Orange County, the city set up red-light cameras at accident-prone locations in several areas of the city. These include cameras at Camino Capistrano and I-5 South Exit off ramp, Camino Del Avion and Del Obispo, and Del Obispo and Ortega Highway.

Also helping to bring down Orange County car collision rate are DUI and Driver’s License Checkpoints, which were conducted March 21, 2009. The checkpoints helped identify and/or remove traffic violators and drunk drivers from city streets. Roving DUI patrols and checkpoints also serve to educate the public on the risks of impaired driving, and to prompt drunk drivers to use designated drivers that have remained sober.

San Juan Capistrano car collision attorneys widely recognize that law enforcement efforts to remove drunk drivers from San Juan Capistrano roads can enhance the safety of city streets.

Alleviate Stress Of Dealing With Insurance Companies In Personal Injury Cases

May 23rd, 2009

It isn’t uncommon for personal injury accidents to occur when circumstances are critical or dangerous. You may be involved in critical situations at work on a daily basis. You likely face dangerous conditions during rush hour traffic on the roads every day. Your home, workplace, or another location may be the scene of potentially unsafe circumstances and consequences for you all the time. Personal injury accidents are usually unpredictable and, oftentimes, unpreventable. Although you may face dangerous circumstances on a daily basis, your chances of getting hurt may depend mostly on whether or not those around you are behaving responsibly. If you’ve been injured in any one of these scenarios and you believe that the accident was due to the negligence of another person or party, you should contact a personal injury lawyer immediately to help you file a claim.

In order to fully recover from your accident, you will likely need to seek medical attention. Most personal injury lawyers will suggest that you get medical help for any potential injuries you have incurred during the incident, even if they are not immediately visible. Minor injuries can lead to major detriments later on in life, so it’s important that you receive a full physical examination following your accident, even if you don’t have a lot of pain initially. If you’ve never been in the hospital or received any type of major medical help before, you will likely be surprised, and perhaps even overwhelmed at how expensive medical costs really can be. If your accident was caused by the neglect or negligent conduct of another person, they should be held liable for those medical costs, not you. In order to determine whether or not you truly were the victim of a valid personal injury claim, you should contact a personal injury lawyer immediately following the incident. He or she will have the training and education necessary to help you make that determination.

A personal injury lawyer will also be able to help you determine how much your claim is worth. He or she will be specialized in this area of the law and will therefore have background in similar cases. Whether your injury was the result of falling off of a defective ladder or being hit by a reckless motorist on the road, your lawyer will almost certainly have handled cases just like yours. This means that your lawyer will have specific experience in determining a settlement amount based upon your unique circumstances. Many factors must be taken into account when determining a rightful settlement amount to request. Your medical bills will perhaps be the biggest determiner, but other such costs can include physical therapy, property damage, legal and judicial fees, and monetary compensation for the pain and suffering you’ve been forced to bear. Depending on the severity and circumstances of your accident, there may be other determiners to consider as well. A personal injury lawyer will be able to help you account for everything you need to know and fight for in your personal injury claim.
