California’s Motorcycle Helmet Law Helps Reduce Traumatic Brain Injury

November 27th, 2008

After Pennsylvania’s motorcycle helmet law was reversed, motorcyclists are no longer required to wear protective head gear. Now some California motorcyclists are trying to work towards removing California’s motorcycle helmet law, which requires the use of a helmet at all times. Some riders argue that the helmet limits the sight and hearing of the motorcycle rider, putting the rider in danger of having some type of motorcycle accident. The University of Pittsburgh performed research to analyze the effect on the number of motorcycle injuries and fatalities since the law was overturned. The conclusion was that the number of motorcycle riders that died of traumatic head injuries increased by 32%. Even with these findings Pennsylvania’s law still allows motorcyclists to ride without a helmet.

Get Out of Your Car If You Are on the Hard Shoulder of a Motorway (You Could Save Your Life)

November 26th, 2008

Accidents On The Hard Shoulder - Get Out Of Your Car To Avoid Injury

If you find yourself on a motorway hard shoulder, it is absolutely vital that you get out of your car and climb the motorway embankment. Failing to do so could cost you a great deal more than the cold you will catch standing out in the rain whilst you wait for a recovery vehicle. This article explains why you must get out of your car if you ever find yourself on a hard shoulder on the motorway.

Why Must I Get Out Of My Car?

People who remain in their car on the hard shoulder are seven times more likely to be injured than those who get out of their car and walk away from it and climb or walk up the motorway embankment. This is especially important if you are on the hard shoulder when it is dark. Although many women may feel nervous away from their cars and be scared of a possible attack by leaving their car, the truth is that they will have far more chances of being seriously injured by another vehicle colliding with their car if they stay in it on the hard shoulder. Please remember this and get out of your car if you ever find yourself on the hard shoulder. The reasons why appear further on in this article.

Why Is It Safer Out Of The Car?

The main reason, and this is especially true at night, is that often the heavy good vehicles travel in the near side lane (ie the one next to the hard shoulder) and often these commercial drivers have been driving for long periods of time. If they are tired they can mistake the lights on your car as showing that you are in the inside lane and move over to join the hard shoulder, realising their mistake too later and crushing your car (and causing injury to you if you are still in it).

How Should I Get Out Of The Car?

You should ensure that everyone gets out of the car on the near side of it; the side that is next to the motorway bank. No one should get out of the driver’s side of the car in case a driver drifts over and collides with your car door, or worse still, you. Even if you have young children or babies, getting them out of the car as soon as possible, even if it is raining, could be the best thing that you ever do for them. What would you rather, a cold from being out in the rain, or possible fatal injuries through leaving them in the car that was subsequently crushed by a lorry? I am sorry to be so brutal, but it is much better that you hear real and beneficial advice to protect your family than I try and flower up this article.

What If I Have A Puncture?

Once you have safely pulled your vehicle over t the hard shoulder, turn the wheels of your car to face into the bank of the motorway. This way, if anyone collides with your car it will not cause more damage to it and other cars by swerving back onto the carriageway. It will simply be pushed up the motorway bank and away from causing harm to anyone else.

Do not attempt to repair the puncture yourself, call your emergency vehicle recovery company to come and make the repair or switch the tyre for you. They will be trained to do it in the safest possible way. Many people have been killed whilst trying to repair a puncture on the hard shoulder. Once again, which would you prefer a bill for the repair or keeping your health? It really can be that choice that you are making if you decide to attempt the puncture repair yourself.

Summary

I hope that we have convinced you that if you every find yourself on the hard shoulder, following an accident or a breakdown, you must get yourself and your family out of your vehicle as soon as possible. You may take a lot of shouting from your family, but that will be a small price to pay if you save yours and their lives.

Paul J Napoli Will Help You Win Your Personal Injury Case

November 25th, 2008

Having a child who is bullied at school is a parent’s worst fear. To have your child physically and emotionally abused by another child can make any parents cringe. Schools are supposed to be considered safe havens for many children, a place where they can go and not have to worry about being threatened or injured, but for many children it is not. Sometimes the bullying is so severe that the child being bullied suffers injuries that are only healed by surgery. Like in the recent case of an 11 year old boy who was beaten up so badly in school that the child was left needing brain surgery after he were punched in the face. After the child was brought to a local hospital it was discovered that the boy had a fractured skull that could only be repaired by doctors doing surgery that will leave the boy with three metal plates in his head. Attorney Paul J Napoli has dealt with personal injury cases similar to this and sees the continuing trend of bullies in school. The young boy’s parents filed a lawsuit for over $3,000,000 against the entire school for the incident which occurred in the end of September as the children were lining up to go back into school after recess.

According to Paul J Napoli, personal injury lawsuits can be filed when the client has been injured financially, or physically as the result of another. In this case the child and his parents filed the lawsuit against the boy’s school, after school officials ignored complaints that stem back to almost three years before. These complaints went on for three years before the boy was so severely injured that he needed surgery. In Paul J Napoli’s eyes, this is unacceptable. For a child to undergo bullying is terrible, but for a child to suffer at the hands of another child for three years before something is done about the situation is appalling. To make this situation more tragic, the boy was punched a day earlier by the exact same boy and reported it to his teacher and the school secretary, and neither of them did anything about it, the boys parents were not even informed of the accident.

The lawsuit that was filed by the boys parent’s claims that the teachers and authorities at the school were careless and negligent when it came to protecting their child. Not only did the school not inform the parents about the first incident that occurred the day before, the school also allowed the child to be bullied for years leading up to the incident. In every school district there are laws that govern what teachers are responsible for, and protecting the children who attend the school and the boy’s school did not abide by these laws. Paul J Napoli has dealt with personal injury cases similar to this in the past and in many of these cases the victim has not only suffered emotional problems, but has suffered permanent injuries such as short-term memory loss, or headaches.

Marc J Bern Can Help You if You Have Suffered

November 23rd, 2008

In the middle of September the U.S Food and Drug Administration (FDA) notified Ranbaxy, that the FDA will block entry of their products into the United States. Ranbaxy, an Indian generic drug producing giant, sells more than 20 different types of generic drugs to the United States. This notification was administered after it was found that Ranbaxy did not follow the correct standards while producing the generic drugs. It was discovered that they did not follow proper manufacturing standards when producing generic versions of drug that are used to treat diabetes, high cholesterol, and epilepsy. The qualities of the generic drugs that are produced by Ranbaxy have also been called into question after some were found to be of insufficient quality.

Although no evidence has been found that consumers have suffered as a result of the carelessness of Ranbaxy, there are many other drug manufacturers similar to Ranbaxy that have caused serious suffering and even death. If you have been affected by one of these drugs Marc j bern asks that you step forward and file a lawsuit. A recall has not been issued, and the company stresses to patients taking generic drugs produced by Ranbaxy to continue to take these drugs because stopping the use of them could be very dangerous for the health of the patient.

Over the past few years Marc j bern has dealt with many lawsuits for the misuse and low quality of generic drugs that are produced overseas. One of the most recent products that was taken off the market was a generic form of the drug Heparin, after it contributed to more than 19 deaths and many more allergic reactions. The generic form of Herapin, which is used as a blood thinner, was found to be contaminated. Generic Herapin is a drug produced by the mucous found in animal tissues, and during recent manufacturing of generic Herapin, it was discovered that the drug had been contaminated by an unnatural chemical, which caused the deaths and allergic reactions. If you or a loved one was one of the individual affected by the generic drug of Herapin, contact Marc j bern to file a lawsuit.

Every month new drugs are discovered that cause serious side effects and death. Many of these drug manufacturers have hid the dangers of these drugs from the FDA and from the public in order to make greater profits. Marc j bern is an expert when it comes to winning cases for people who have been affected by these types of drugs. Many of the dangers of these drugs can be contributed to the quality of low-cost generic drugs that are manufactured. The use of generic drugs has been one of the greatest things for the American public, allowing consumers to purchase drugs for much lower costs, but with many of these generic drugs are produced overseas are much harder to regulate than American produced drugs. Some of these low-cost drugs, such as generic Herapin are manufactured in small, unregistered, workshops in other countries.

Traffic Accidents Are Personal Injuries

November 22nd, 2008

There are a variety of ways an injured driver may try to collect damages for an accident, not the least of which is filing suit against a car maker (if mechanical faults were the reason for the crash) or file suit against the party the driver thinks is responsible for the accident. Thinking someone is responsible for an accident and proving that are two different things, and it is crucial you have an experienced auto accident attorney to handle your case. It’s one thing to be able to say you represent injured drivers, but another thing to actually lay claim to being fully qualified and certified to handle civil trial law in Florida.

Take Pictures of Your Injury Then Call Attorney Marc J Bern

November 21st, 2008

For many people the hiring of a personal injury attorney may not happen until weeks after the injury has occurred. This is normally because the person who is injured is unable to contact the proper attorney until they are feeling better. Although this is okay, there is one big thing you need to do when you are recovering in order to make your life a whole lot easier when trying to file a personal injury lawsuit, and that is take pictures.

Taking pictures not only proves that the injury occurred, it also shows the depth of the injury, attorney Marc J bern has dealt with many cases in which pictures have made the case. For example, say you were in a car accident and had both legs broken, as hard as it may be it would be ideal if there were pictures of your legs right after the injury occurred so that a judge can see the extent of the injury. Also, pictures of the casts that were put on your legs or any additional medical service you may have had to go through such as surgery or resetting of the bones. Although this can be a very hard time to take pictures it can make the recovery of money for your accident much easier. Also, Marc J bern suggests if there was any bruising as a result of the accident this is also important. When these pictures are taken it is also very important to take them with a camera which will have date developed on the picture so the time the injury is occurred is on there, if you are unable to use a camera with a date make sure to write down the date and time that the pictures were taken on the back of the photo.

It is also very important to take pictures of the accident scene. When an accident occurs it is often cleaned up right away so there is no second chance to take a picture. This can show the damages done to your personal property and any other information that Marc J Bern may need to prove your case. If it is a car accident claim get pictures of all of the cars involved, the location of any debris that are a result of the accident. Also get the names and pictures of any personnel on the scene whether it be EMT or police. This can later help if you need people to testify in court about the severity of the accident.

Marc J bern understands that the time following accidents can be a very traumatic and stressful time, but without pictures sometimes it can be very hard to prove that an accident is deserving of a lawsuit. If you are unable to take the pictures after the accident many doctors or EMTs on the scene should be more than willing to take pictures for you. Also, many people had had family members take pictures if they were unable to during recovery.
